Truest Consulting Supports Wagwear in Securing Permanent Injunction
Truest Consulting is proud to announce its role in a significant intellectual property victory for Wagwear LLC. The United States District Court for the Northern District of New York has issued a Permanent Injunction and Final Judgment in favor of Wagwear, prohibiting Guangzhou Haoqian Trading Co., Ltd (Zealting) from selling infringing dog boot products on Amazon and other platforms.
This ruling marks a decisive win for Wagwear and reinforces the importance of protecting design patent rights. Wagwear, a pioneer in upscale pet wear and creator of the iconic WAGWELLIES® dog boots, faced ongoing infringement that threatened its market position, brand reputation, and intellectual property value.
To support Wagwear’s claims, Justin Lewis, CEO of Truest, provided expert analysis and testimony regarding the irreparable harm caused by Zealting’s infringing activities. Mr. Lewis’ declaration detailed the economic and financial impact of the infringement, including:
Loss of market share and sales momentum due to direct competition on Amazon.
Price erosion and reputational harm, as Zealting’s lower-priced products undermined Wagwear’s premium positioning.
Encouragement of additional infringement, risking long-term damage to Wagwear’s brand and IP value.
The Court found that Wagwear was likely to suffer irreparable harm absent injunctive relief and granted a permanent injunction, affirming the strength of Wagwear’s design patents and the remedies available to IP owners under U.S. law.
“Obtaining this injunction was critical given the documented irreparable harm to our client,” said Nick Baciu, Co-Founder and COO of Truest. “The proliferation of infringing goods on Amazon and similar e-commerce platforms makes immediate judicial intervention increasingly necessary to protect intellectual property rights and prevent ongoing damage to companies like Wagwear.”
